SURVEYSX – Terms of Service (AGB)

Status: 2025

1. Scope

These Terms of Service (ToS) apply to all contracts, services, and offers on the SurveysX platform, operated by:

Trendsolve – Owner: Fikret Onur Çinsar (Sole Proprietorship)
Kurstr. 2, 13585 Berlin, Germany.

By registering or using the platform, users accept these ToS.

2. Subject of Contract

SurveysX provides an online software (SaaS) for creating, managing, and evaluating surveys.
Usage takes place exclusively over the Internet.

3. User Accounts

Creating an account is required to use the platform.
The following data must be provided during registration:

  • First and Last Name
  • Email
  • Username
  • Phone Number
  • Password (stored hashed)

The user is obligated to:

  • Keep access data confidential
  • Prevent unauthorized access
  • Notify changes immediately

4. Conclusion of Contract

A contract is concluded by:

  • Registration of an account AND
  • Selection of a subscription (Monthly / Yearly) AND
  • successful payment via Stripe or
  • payment via SEPA Transfer (for corporate customers)

5. Services

SurveysX offers, among other things, the following functions:

  • Creation and management of surveys
  • Analysis and reporting functions
  • Export of data (PDF, CSV, Excel)
  • User management
  • Uploading of content

The scope of functions may vary depending on the plan.

6. Prices & Payment

6.1 Private and Business Customers (Stripe)

Payment is made via Stripe using:

  • Credit Card
  • Debit Card
  • Apple Pay (if available)
  • Other Stripe methods

6.2 Corporate Customers (SEPA)

Corporate customers receive an offer and pay via bank transfer.
Payment term: 14 days net.

6.3 Subscriptions

Monthly and yearly plans are offered.

  • Monthly subscription → monthly automatic renewal
  • Yearly subscription → automatic yearly renewal

7. Termination & End of Contract

7.1 User Termination

  • Monthly subscription → cancelable at any time with effect for the next month
  • Yearly subscription → cancelable at any time for the next billing period
  • Cancellation via the Dashboard or by Email

7.2 Provider Termination

The provider may terminate in case of:

  • Violation of ToS
  • Misuse of the platform
  • Violation of laws or third-party rights

8. Responsibility for Content

8.1 User Content

All content processed by a user via SurveysX is exclusively their responsibility.
This includes:

  • Questions, texts, data
  • Answers of participants
  • Uploaded files
  • Personal or sensitive data

8.2 Special Categories of Personal Data

If users collect sensitive data (Art. 9 GDPR) via surveys, they must:

  • Obtain valid consent
  • Provide legal bases themselves
  • Inform participants according to Art. 13 GDPR

SurveysX is not the controller for this data.
The provider acts exclusively as a Processor according to Art. 28 GDPR.

9. Availability & Maintenance

SurveysX guarantees an availability of 98% on an annual average.
Excluded are:

  • Announced maintenance work
  • Force majeure
  • Failures caused by third parties (Stripe, Hostinger etc.)

10. Liability

The provider is not liable for:

  • Content of users
  • Data loss due to incorrect exports
  • Incorrect use of the platform
  • Damages caused by third parties or failures of external services

Liability limitation according to Art. 309 No. 7 BGB.

11. Privacy

Processing of personal data takes place according to:

  • GDPR (EU)
  • BDSG (Germany)
  • TTDSG

12. Place of Jurisdiction

Place of jurisdiction is Berlin, as far as legally permissible.
